Welcome to Demand Scaling. By accessing or using our website and services, you agree to the following Terms & Conditions. Please read them carefully.

1. Use of Services

You agree to use our services only for lawful purposes. You are responsible for the accuracy of any data you provide (e.g., customer names, phone numbers, emails).

2. Intellectual Property

All content, trademarks, and software provided by Demand Scaling remain our property. You may not copy, modify, distribute, or resell our services without permission.

3. Payments & Fees

All fees for services are due as agreed. Failure to pay may result in suspension or termination of services. Setup fees are non-refundable unless specified otherwise.

4. Service Availability

We aim for 24/7 availability but do not guarantee uninterrupted access. We are not liable for downtime caused by third-party failures, internet outages, or other factors outside our control.

5. Limitation of Liability

Demand Scaling is not liable for indirect, incidental, or consequential damages arising from use of our services, including lost revenue, missed jobs, or errors caused by inaccurate client data.

6. Termination

We reserve the right to suspend or terminate your access if you violate these Terms, misuse the service, or fail to make payment.

7. Governing Law

These Terms are governed by the laws of Massachusetts, United States. Any disputes will be resolved in the courts of that jurisdiction.

8. Changes to Terms

We may update these Terms from time to time. Changes will be posted here with the revised effective date.

9. Guarantee & Refund Policy

Our Promise: Within 90 days, if your AI receptionist does not (i) book at least 10 jobs or (ii) capture 90%+ of your inbound leads, we will continue working for free until these benchmarks are met. Additionally, if we ever miss more than 10% of your inbound calls, texts, or chats, you will receive a full refund — including any setup fees.

Traffic Requirements: This guarantee applies only where the client’s inbound lead volume is sufficient to reasonably achieve the stated benchmarks.

  • For businesses receiving 30 or more inbound leads per month (calls, texts, chats combined), the full guarantee applies, including the “10 jobs in 90 days” benchmark.
  • For businesses receiving fewer than 30 inbound leads per month, the guarantee scales proportionally. Example: if you receive 15 inbound leads in a 30-day period, the guarantee applies to capturing 90%+ of those leads (13–14), but not to booking 10 jobs.

Exclusions: This guarantee does not apply in cases where inbound traffic is insufficient, client-provided lead data is inaccurate, or client staff fail to honor scheduled jobs or appointments.
